Consumers have been complaining about excessive fees by Walgreens Pharmacy for copies and/or searches of their pharmacy records. Certain state and federal laws require Walgreens to make pharmacy records available to patients and charge them reasonable, cost-based fees for inspecting, copying, and retrieving such records. We are investigating whether Walgreens has implemented a widespread and systematic business practice of charging and collecting an established flat-fee from customers and/or their authorized representatives who request the customer’s pharmacy records from Walgreens, irrespective of the actual costs and expense incurred in fulfilling the records requests.
Contrary to the terms of the agreement entered into by Walgreens and the customer, or the customer’s authorized representative, and possibly in violation of federal and state laws, the flat-fee charged for the pharmacy records may have not been “reasonable” or “cost-based.” In some cases, Walgreens may have charged excessive fees even when no records were ultimately provided.
