The law firm of Milberg LLP has filed a complaint against insurer USAA alleging violations of New York’s Comprehensive Automobile Insurance Reparations Act, commonly known as “no-fault” insurance.
The complaint alleges that USAA improperly calculates the benefits it owes to no-fault claimants under New York law, by applying certain deductions in an improper fashion. As a result, claimants receive less than the full amounts to which they are entitled. The complaint alleges that these actions violate New York’s insurance and consumer protection laws, as well as common-law tenets of contract and quasi-contract.
