The law firm of Milberg LLP is investigating Entergy Corporation (NYSE: ETR) for possible  U.S. antitrust law violations pertaining to potential anti-competitive conduct at its utility units in Arkansas, Texas, Mississippi, New Orleans, and Louisiana.  On October 12, 2010, Entergy announced that the U.S. Department of Justice opened a civil investigation of competitive issues concerning certain generation procurement, dispatch, and transmission system practices and policies of Entergy’s utility companies.  The Entergy utility companies under investigation are: Entergy Arkansas Inc.; Entergy Gulf States Louisiana LLC; Entergy Louisiana LLC; Entergy Mississippi Inc.; Entergy New Orleans Inc.; Entergy Texas Inc.; and Entergy Services Inc.

The Louisiana Public Service Commission formally lodged a complaint with the Federal Energy Regulatory Commission on June 29, 2010, claiming that Entergy Arkansas Inc. improperly sold low-cost electric energy intended for system affiliates to third-party power marketers, thus forcing higher costs onto ratepayers.

The company is also facing a suit by the attorney general of Mississippi, where the Company acts as a state-sanctioned monopoly.  Attorney General Jim Hood has accused the Company of using “a patchwork of shady accounting mechanisms” to overcharge Mississippi consumers for energy in violation of their antitrust exemption agreement.
