The law firm of Milberg LLP is investigating possible violations of consumer protection laws by Spectre Performance, a maker of air filters and intake systems used in automobile engines. Spectre Performance sells car products and kits that it advertises as improving fuel and horsepower performance.
On December 8, 2011, a federal court found that Spectre Performance had misrepresented the benefits of its air filters regarding fuel economy, efficiency, and performance. The court found that Spectre Performance’s representations that its air filters and air intake systems “save gas” and that “[g]overnment studies show that an efficient air filter can give you up to 10% better fuel economy, which translates to money in your pocket” were false, and said that a government study actually showed that air filters make almost no difference in fuel economy.
According to the court’s opinion, Spectre also claimed that “[a]ll Speed By Spectre hpR filters are tested at independent labs using ISO 5011 standards, and have been proven to filter 99.6% of particles.” Again, the court found that this statement was false — instead of testing all of its filters, Spectre only tested one filter, and that filter was specially designed for the test, not selected from a production run. According to the court’s opinion, “there is no basis on which to conclude that that any hpR filter sold by Spectre will have the same efficiency as the sample filter that was tested.”
Similarly, the court found that Spectre used a graph entitled “Dyno Gains” on the packaging for its air filters and air intake systems to claim that “replacing your stock filter with a Speed By Spectre hpR filter will result in real power gains,” and that the graph purported to show increases of as much as 35% in horsepower. In fact, according to the court’s opinion, those claims are untrue.
If these allegations are true — and a court has already determined that they are — Spectre has violated consumer protection laws. However, the court’s opinion was handed down in a case brought against Spectre by one of its competitors. Therefore, injured consumers will not receive any compensation unless they take action to protect their rights.
